Terms and Conditions

The rules that apply when you use this website or purchase services from Advanced Power Technology Limited.

These Terms govern your access to and use of all content and services made available through the website operated by Advanced Power Technology Limited (the “Service”). References to “we”, “us”, or “our” mean Advanced Power Technology Limited unless the context requires otherwise.

By accessing or using any part of the Service you agree to be bound by these Terms. If you do not agree, you must not use the website or instruct us to perform work.

Orders, contracts, and payment

Supply of engineering services, equipment, installation support, or maintenance is governed by a separate quotation, order acknowledgement, or written agreement (including schedules and specifications) that defines scope, deliverables, acceptance, timelines, and price (“Contract”). Fees are due as stated in the Contract. Third-party hardware, software licences, or utility charges may be invoiced separately or passed through as agreed. We may suspend work where amounts materially overdue remain unpaid, subject to any statutory rights you may have as a consumer or business customer.

Intellectual property

Except as expressly agreed in writing, we retain ownership of pre-existing methodologies, templates, software tools, and generic know-how. Deliverables created specifically for you and paid for in full become yours only to the extent stated in the Contract (for example, as-built documentation or commissioned reports). You must not remove proprietary notices where supplied.

Third-party products and services

Projects often involve equipment or platforms manufactured or hosted by third parties (“Third-Party Services”). Your use of those products is additionally subject to the relevant supplier’s terms and warranties.

If you use Third-Party Services in connection with our work:

  • You accept that we are not responsible for faults, delays, or policy changes originating with the third party.
  • You acknowledge that we are not liable for loss or damage alleged to arise solely from content, goods, or services accessed through third-party websites or applications, except where the law does not permit that exclusion.

Accounts and access

Where we provide a client portal, ticketing system, or file share, you agree to supply accurate registration information and to keep passwords confidential. You are responsible for activity under your credentials and must notify us promptly of suspected unauthorised use.

Suspension and termination

We may suspend or terminate access to online tools or discontinue Services where required by law, for non-payment where permitted, or for material breach of the Contract after reasonable notice where notice is practical. Specific exit, handover, and payment obligations on termination are set out in the Contract.

Disclaimer

The website and any informal guidance obtained through it are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Advanced Power Technology Limited disclaims all implied warranties including as to merchantability, fitness for a particular purpose, and non-infringement. Formal design responsibility, performance guarantees, and liability caps are defined only in a signed Contract—not by marketing descriptions or illustrative calculators on this site.

Governing law and jurisdiction

Unless mandatory local law provides otherwise, these Terms and any dispute arising from the website or non-contractual matters related to it are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without prejudice to any right to serve process or enforce judgments elsewhere.

Changes

We may update these Terms from time to time. Material changes will be indicated by revising the “last updated” date on this page or by other reasonable means. Continued use of the website after changes take effect constitutes acceptance of the revised Terms.
